Zabita punched Chabak, age 49, in the chest, and attempted to flee. He was pursued and tackled in the lot by Officers Gavin Sheehan and Rick Bachmann. Bachmann, age 29, injured his right knee during the apprehension when he fell to the pavement. Sheehan, age 36, injured his right hip when he fell on his holster during the arrest. Zabita was charged with aggravated assault on a police officer and throwing bodily fluids for spitting at the officers. A BJ’s employee also told police Zabita broke one of their store windows resulting in a criminal mischief charge. He was transported to Trinitas Hospital for a psychological evaluation after being issued summonses with a county court date set for January 23rd.
