On
January 16, 2012 at 10:06 PM officers were sent to BJ’s ,1001 E. Edgar
Rd. on a man assaulting a woman in the parking lot. Police located the
female, a 27 year old from Roselle, who was visibly upset and crying.
While the officers were speaking to her, the man, James Zabita, age 28,
of Linden, attempted to run toward the woman but was blocked by Sgt.
Edward Chabak. Zabita punched Chabak, age 49, in the chest, and
attempted to flee. He was pursued and tackled in the lot by Officers
Gavin Sheehan and Rick Bachmann. Zabita continued to fight with the
officers and had to be subdued with pepper spray before he was
handcuffed. Bachmann, age 29, injured his right knee during the
apprehension when he fell to the pavement. Sheehan, age 36, injured his
right hip when he fell on his holster during the arrest. Zabita was
charged with aggravated assault on a police officer and throwing bodily
fluids for spitting at the officers. A BJ’s employee also told police
Zabita broke one of their store windows resulting in a criminal mischief
charge. He was transported to Trinitas Hospital for a psychological
evaluation after being issued summonses with a county court date set for
January 23rd.
